Article 1 – Applicability

1.1 These general terms and conditions apply to all legal relationships between Fanbased B.V. (hereinafter Contractor) and Client, including all Services provided by Contractor and in particular the services stated in the Proposal.

1.2 Deviations from these general terms and conditions are only valid if explicitly agreed in writing. Contractor expressly rejects the applicability of any general (purchasing) terms used by Client.

Article 2 – Obligations

2.1 Contractor shall exercise the greatest possible care regarding the interests of Client when performing the Services. In particular, Contractor safeguards the confidentiality of all data and information made available by Client under the Agreement.

2.2 Insofar as proper performance of the Agreement requires it, Contractor has the right to have the Services performed by third parties. Where Fanbased engages third parties, the general terms of those third parties apply.

Article 3 – Proposals

3.1 All Proposals are entirely without obligation and Contractor is only bound by a Proposal if it is signed by Client and received by Contractor within fourteen (14) days.

3.2 Prices stated in a Proposal exclude VAT and other government levies, as well as any costs incurred under the Agreement, including shipping and administration costs, unless stated otherwise in the Proposal.
